Simmons v. State of Florida, 1D06-4544

A petition for writ of mandamus, seeking to compel an agency to provide petitioner a clear point of entry into agency proceedings concerning the denial of his request to enroll as a provider in the Medicaid Program, is granted to the extent that the agency failed to meet its clear legal duty, under Florida Statutes section 120.569(2)(a), to enter an order granting or denying his petition for formal administrative hearing.
