Disque v. Unger, 4D05-2976

Dismissal of an action brought in probate court for declaratory relief as to the interpretation of certain language in a property settlement agreement is affirmed where it was undisputed that the estate could not benefit financially, and that further litigation would deplete the assets which would otherwise go to interested persons.
