Lutz v. Protective Life Ins. Co., 4D05-1405

Judgment on the pleadings for insurer in a class action suit for breach of contract and declaratory judgment involving an out-of-state group health insurance policy is affirmed as to the breach of contract claim but reversed as to the declaratory judgment claim where the pleadings demonstrated that plaintiff was entitled to have the trial court resolve whether the insurer failed to comply with Fla. Stat. section 627.6515(2), such that the policy would be subject to the general provisions of Part VII of Chapter 627.
