Nesbitt v. State of Florida, 4D04-1991

On remand from the Florida Supreme Court, the court affirms a denial of rule 3.850 relief regarding a habitual offender sentence, pursuant to the Florida Supreme Court's ruling that the sanction of probation is a "sentence" for purposes of applying the sequential conviction requirement of the habitual felony offender statute.
