District Court of Appeal of Florida
Butler v. Bay Ctr., 1D06-1235
For purposes of a worker's compensation claimant's procedural right to request a one-time "change of physician during the course of treatment," before requesting another authorized physician, a claimant must at least begin treatment with the physician the claimant seeks to change. In a workers' compensation case, denial of a claimant's petition for benefits (PFB) seeking treatment from a specified pain management physician is affirmed where the E/C had no duty to authorize another pain management physician because claimant had not received treatment from a physician timely authorized by the E/C.
