Manning v. Tunnell, 1D04-0416
Dismissal with prejudice, pursuant to the statute of limitations, of a complaint against a county and a contractor-prison operator, based on alleged deprivations of plaintiff's constitutional rights and false imprisonment, is affirmed where plaintiff failed to raise his claim regarding the equitable tolling provision of 28 U.S.C. section 1367(d) in the trial court, and claims against the contractor were clearly barred by statute.
