District Court of Appeal of Florida

Higgins v. Higgins, 2D06-286

Postjudgment orders holding former wife in criminal contempt and transferring custody of the parties' son from her to former husband are reversed where: 1) the court failed to comply with requisite procedures for purposes of the contempt order; and 2) the child custody modification was an abuse of discretion whether the judge in the case approved a hastily drafted agreement, or whether he ordered a change of custody without taking evidence.
