District Court of Appeal of Florida

Horton v. State of Florida, 2D06-255

A conviction for failure of a sex offender to report a change of address is reversed and remanded for a new trial where the trial court erred in allowing the state to introduce into evidence defendant's prior conviction for the same offense since the evidence of the prior conviction had no probative value as to any disputed issue, and the prejudice outweighed the probative value of the prior conviction.
