Lalonde v. Checker's Drive-In Restaurants, Inc., 1D05-3160

An order of a Judge of Compensation Claims is affirmed as to issues raised by the claimant in a worker's compensation case but reversed in part where: 1) the JCC erred in awarding temporary total disability (TTD) benefits for a certain time period as there was no competent, substantial record evidence establishing that claimant believed he could not work and claimant was working, and futhermore, claimant had reached maximum medical improvement; and 2) the JCC erred in failing to rule on E/C's defense of fraud.
