District Court of Appeal of Florida

H.P.B.C., Inc. v. Nor-Tech Powerboats, Inc., 2D05-1961

In a dispute concerning an alleged oral contract which a dealer asserted entitled it to commission payments based on manufacturer's boat sales, a judgment entered following the reinstatement of a $290,900 jury verdict in favor of dealer is reversed where the oral contract did not satisfy Florida's statutes of frauds, and therefore, dealer's alleged entitlement to commissions was barred.
