Summary judgment for defendant in a negligence action arising from an accident in which plaintiff was injured after falling from a lift being used in preparation for a concert is reversed where: 1) there were genuine issues of material fact concerning whether defendant owed a legal duty to plaintiff and whether that duty was violated; and 2) the trial court also erred in concluding that defendant was entitled to workers- compensation immunity.
