District Court of Appeal of Florida

Moore v. State of Florida, 1D05-5555

Defendant's convictions and sentences for lewd and lascivious molestation on a child and for lewd and lascivious exhibition are affirmed over claims that the trial judge abused his discretion: 1) when he allowed similar fact evidence of a prior incident of child molestation to be heard by the jury; 2) in allowing three different witnesses to testify to the child's hearsay statements; and 3) in allowing the jury to learn of his prior criminal record.
