Cont'l Stevedoring & Terminals, Inc. v. P&O Ports Florida, Inc., 3d06-0126
On remand, final judgment in a suit for declaratory and injunctive relief seeking a determination that an offer to buy out plaintiff's interest in a company according to the terms of a buy-sell agreement was unenforceable is affirmed where: 1) the appellate court's determination that the offer was void also voided the injunction against enforcement of the offer; and 2) the inclusion of a special master's findings concerning plaintiff's allegations of bad faith, default and breach were within the court's authority since neither party raised the issue on appeal.
