Stoppa v. Sussco, Inc., 3d05-2490

Grant of motion to require compliance with a final judgment and denial of emergency motion for relief from final judgment are both affirmed in a suit for specific performance of a contract for the sale of a home where: 1) the trial court exercised its independent judgment in entering the first order; 2) defendant was given the opportunity to object to the proposed order; 3) a trial court does not have jurisdiction to review an order while the order is pending on appeal.
