District Court of Appeal of Florida
Murphy v. Courtesy Ford, LLC, 3d05-1896
Order compelling arbitration and denial of motion for rehearing in a suit for damages under Florida's Deceptive and Unfair Trade Practices Act involving the repossession of an automobile are both affirmed where: 1) a significant relationship existed between the claim and the agreement containing the arbitration clause; and 2) the trial court was correct in finding that plaintiff failed to make a sufficient showing of unconscionability to overcome the arbitration agreement.
