Gast v. Mak Enters. of Gainesville, 5D06-502
Summary judgment entered in favor of defendants on a claim for fraud and conspiracy arising out of the repair of plaintiff's motor vehicle's air conditioning system is reversed where a disparity in the dimensions of parts in plaintiff's vehicle to those averred by defendants to have been installed, created an inference that the parts asserted to have been installed by defendants were not in fact installed, and thus summary judgment was inappropriate.
