District Court of Appeal of Florida

Antoury v. State of Florida, 5D05-2880

Defendant's convictions for attempted sexual battery and battery is reversed and remanded for a new trial where: 1) the trial court did not abuse its discretion in excluding evidence of the victim's history of sexual abuse and mental illness as defendant failed to demonstrate the relevance of that evidence; but 2) the trial court erred by depriving him of a full and fair cross-examination of an investigating officer.
