FedEx Ground Package Sys. v. Futch, 3d05-2228

In a personal injury suit, judgment for plaintiff is affirmed where the trial court did not abuse its discretion in excluding evidence of a plaintiff witness' prior conviction for income tax evasion after determining that it did not constitute a conviction involving dishonesty or a false statement since the trial judge properly recognized that he was not to conduct a "trial within a trial" and made his ruling based solely on the case law presented to him and his own legal analysis.
