Allstate Ins. Co. v. Regar, 2D05-4719

An assignee of a third-party bad faith claim is entitled to attorney's fees pursuant to Florida Statutes section 627.428 when the assignee obtains a favorable judgment in the bad faith action. An order awarding plaintiff attorney's fees in her capacity as assignee of an individual's third-party bad faith action against insurer is affirmed where the trial court properly awarded the fees pursuant to section 627.428, and properly determined that it had the discretion to apply a multiplier to the fees.
