Dep't of Children & Families v. Wehrwein, 5D06-1613
A petition for writ of certiorari seeking review of a trial court order committing an individual to the custody of the Department of Children and Families is granted where the overwhelming evidence was that the mental illness causing the individual's incompetency would not respond to treatment and that it was highly unlikely he would ever respond to treatment, and thus, the trial court order violated Florida Statutes section 916.13(1).
