District Court of Appeal of Florida

W.G. v. Dep't of Children & Family Servs., 2D06-1264

An order to show cause why sanctions should not be imposed in a juvenile dependency matter is discharged where it would be inappropriate to impose sanctions on either attorney at issue since they acted with diligence to discharge their professional responsibilities in the matter, and neither of them intended to keep the court in the dark about the identity of the attorney who was responsible for representing father on his appeal. The court sets forth procedural guidelines for courts and attorneys under such circumstances involving the withdrawal of parties' trial counsel and replacement by new counsel for purposes of appeal.
