District Court of Appeal of Florida

Taylor v. Maness, 3d06-0578

Summary judgment for defendants in a dispute over the sale of real property is affirmed where: 1) the extent of homestead protection is a matter of law; 2) the economic loss rule barred recovery for fraud in the inducement and negligent misrepresentation claims; and 3) the presence of homestead rights precluded a tortious interference claim against a party intervening to block the sale contract, since there was an absolute legal right to interfere.
