Costanzo v. Costanzo, 3d05-2205

Denial of a motion to dissolve an injunction for protection against domestic violence is affirmed where: 1) siblings who had resided together at some point in the past fall within the definition of "family or household member"; 2) the injunction could be extended since the original petitioner did not file the motion, thus did not have to present any evidence of new acts; 3) movant was not denied an opportunity to present evidence since he filed his appeal before the trial court could hold an evidentiary hearing.
