District Court of Appeal of Florida

Calixte v. State of Florida, 4D04-2022

Defendant's convictions for robbery with a firearm and kidnapping with a firearm in his possession are reversed and remanded for a new trial pursuant to a claim that the trial court abused its discretion in permitting an investigating detective to testify that stolen property is rarely recovered and that there is often a discrepancy between the defendant's appearance and the description of the perpetrator given by crime victims.
