District Court of Appeal of Florida

214 Main St. Corp. v. Tanksley, 2D06-768

An order vacating and setting aside default and dissolving writ of possession is reversed where: 1) landlords were statutorily entitled to the default and writ of possession when the tenant failed to make a timely payment of rent into the court registry, as required by previous court order; and 2) the applicable statute does not allow for a procedure whereby a trial court may excuse a tenant's noncompliance with its prior order.
