An order terminating mentally retarded claimant's eligibility for the Home and Community Based Services Medicaid Waiver (Med-Waiver) Program is affirmed where there was no error in the determination since claimant - whose monthly income exceeded the allowable substantial gainful activity amount - had been deemed not disabled by the Social Security Administration, and thus was ineligible for the benefits at issue.
