District Court of Appeal of Florida

State of Florida v. Burrows, 1D05-5857

Grant of a defense motion for a judgment of acquittal, following a jury's conviction of defendant for possession of cocaine, is reversed where the state presented competent, substantial evidence sufficient to support the jury-s factual finding that the defendant was guilty of possession of crack cocaine, and, even if this were a wholly circumstantial evidence case, the state presented competent evidence from which the jury could exclude the defendant-s reasonable hypothesis of innocence.
