District Court of Appeal of Florida

Pavilion Apartments v. Wetherington, 1D05-3824

An order requiring a former employer and insurer to reinstate claimant's permanent total disability and supplemental indemnity benefits, with penalties and interest from the date they were suspended, and to furnish the prescribed medical benefits he sought is affirmed where the record fully supported findings made by the JCC with regard to claimant's customary use of a cane and a finding and conclusion that the employer/carrier failed to establish a fraud defense.
