In an appeal from school boards' unsuccessful challenge to the 2004-2005 General Appropriations Act, Laws of Florida chapter 2004-268, involving public school funding, the court affirms the rulings below, and finds that although Simon v. Celebration Co., 883 So. 2d 826 (Fla. 5th DCA 2004), does not hold that no private cause of action exists under Article IX, section 1, of the Florida Constitution for the enforcement of its provisions, a count of the original complaint was nevertheless properly dismissed because it did not state a cause of action under applicable law.
