District Court of Appeal of Florida

Turnbull v. State, 3d05-0272

Conviction and sentence for unlawful driving as a habitual offender are reversed because the State's questioning on racial profiling and use of the elicited responses to strike black jurors constituted a subterfuge to the constitutional principles of the Sixth Amendment-s right to a trial by a jury.
