Donohue v. Brightman, 4D05-3711

A judgment denying claims for declaratory relief and the imposition of a constructive trust on a condominium unit titled in the name of plaintiff's nephew, but in which she had been living and paying expenses for, is reversed where the trial court erred in entering judgment for the nephew when he had been defaulted in the proceeding, and no motion was made to set aside the default or even to answer the complaint.
