Kaplan v. Laratte, 4D05-3586

In a suit for specific performance alleging that defendant had anticipatorily breached two contracts to sell real estate to plaintiff, a trial court's finding that both parties were in default and denial of specific performance is reversed where there was no evidence to support the trial court-s finding that the buyer was not entitled to relief.
