District Court of Appeal of Florida
Ruger v. State of Florida, 4D04-4372
Convictions for second degree murder with a weapon, grand theft, and uttering a forgery are affirmed over claims that the trial court erred: 1) in denying a Nelson challenge; 2) in rejecting a peremptory challenge to a juror; 3) in denying a motion for mistrial based upon improper impeachment of defendant's character; and 4) by allowing the jury to convict him of an enhanced felony without finding the use of a weapon element beyond a reasonable doubt.
