District Court of Appeal of Florida
Arjona v. Torres, 3d06-1395
Non-final order denying husband's motion to dismiss and/or abate the dissolution proceedings initiated by his wife is affirmed despite the existence of simultaneous proceedings initiated by the husband in Mexico where Florida is the "home state" of the couple's minor children and Florida has not declined to exercise jurisdiction over the custody issues of the children, thus the proceedings in Mexico were not commenced substantially in conformity with the jurisdictional requirements of section 61.514 of the Uniform Child Custody Jurisdiction and Enforcement Act.
