District Court of Appeal of Florida

Denial of plaintiff's claim for specific performance of a contract for the sale of real estate is reversed where the essential terms of the purchase agreement were clear and definite. Denial of defendant's counterclaim is affirmed where: 1) defendant waived arguments about a breach of the agreement's terms; and 2) the agreement did not require the dismissal of the current suit before the sale could be closed.
