District Court of Appeal of Florida

Siegel v. Husak, 3d04-2310

Jury verdict against a nurse practitioner for a misdiagnosis that was the ultimate responsibility of her supervising physician is reversed where, although there are circumstances in which a nurse practitioner can be found liable for the misdiagnosis of her supervising physician, there is a lack of competent substantial evidence in the case to support a verdict against defendant.
