District Court of Appeal of Florida
Granell v. Granell, 2D05-3096
Orders adopting a general magistrate's recommended order and denying a former husband's exceptions to the magistrate's report are affirmed in part as to a finding of contempt, and reversed in part as to a finding that the former husband should be obligated to pay former wife's medical expenses where: 1) the magistrate misstated the burden of proof; 2) no findings were made as to whether the medical expenses she claimed were reasonable or necessary; 3) no determination was made as to the former husband's ability to pay such expenses; and 4) no determination was made as to whether any appropriate limitations should be imposed as to his liability for future medical expenses.
