District Court of Appeal of Florida

Dismissal and summary judgment rulings against plaintiff in a wrongful death and survival suit arising from the death of his mother at defendant-hospital is affirmed in part, but reversed in part as to the dismissal of a survival count and summary judgment on another survival count where the trial court erred in finding that "any survival action has been extinguished by the Wrongful Death Act."
