Canseco v. Cheeks, 3d05-1661

Jury award of compensatory and punitive damages against two former professional baseball players for their unprovoked attack on plaintiffs at a nightclub is affirmed where: 1) it is not necessary to introduce expert testimony before admitting medical bills into evidence; 2) the defendants' conduct satisfied the requirements for intentional infliction of emotional distress; 3) intentional battery supplies the requisite proof of malice, justifying a punitive damages award; and 4) the court did not err in holding defendants jointly and severally liable.
