G.R. v. Dept. of Children & Fam. Svs., 2D05-1192, 2D05-1323
The Corrected Order of Dependency Adjudication and Disposition as to both mother and father is reversed for legally insufficient evidence. As to the father, the Dept. of Children and Family Servs. (DFS) failed to establish a nexus between father's abuse of one child and prospective abuse of a second child. As to the mother, DFS failed to adduce evidence of mother's failure to protect one child thereby failing to prove the prospective-abuse of the second child.
