District Court of Appeal of Florida

Moss. v. Moss, 2D03-478, 2D03-2355

On remand from the Florida Supreme Court, the trial court's determination that husband in divorce proceeding was not entitled to an award of attorney's fees is affirmed where his Florida Statutes, section 57.105 claim was rightly decided and his argument regarding the prenuptial agreement was not preserved for appellate review. Husband's claims as to wife's attorney's fees award is not controlled by the Supreme Court decision and stands.
