District Court of Appeal of Florida
Barbara G. Banks, P.A. v. Thomas D. Lardin, P.A., 4D05-3911
In a dispute between law firms over the splitting of a contingency fee received in a successful products liability case, summary judgment for defendant is reversed where the allegations in the complaint indicated that it was the intention of the parties under the contract to divide the attorney's fees upon their receipt by the attorney who obtained them, and thus, the suit was filed well within the statute of limitations.
