District Court of Appeal of Florida

Baker v. State of Florida, 4D05-205

Defendant's conviction for battery on a law enforcement officer is affirmed, without prejudice to his asserting his ineffective assistance claims in a motion for post-conviction relief, where the reasons for his counsel's alleged failure to investigate possible gaps in video evidence were not clear, and he did not preserve for appellate review the issue of ineffective assistance of counsel regarding an internal affairs officer's opinion testimony and his counsel's failure to request a jury instruction on self-defense.
