An order dismissing a prison inmate's tort action against corrections officers is reversed where the trial court: 1) erred as a matter of law in dismissing the complaint for failure to satisfy a purported statutory notice of claim requirement; 2) erred in finding the allegations to be legally insufficient to state a cause of action against defendants pursuant to Florida Statutes section 768.28; and 3) abused its discretion in denying a motion to transfer the case.
