Darwish v. State of Florida, 2D05-4643
A conviction and sentence for the third-degree felony of cheating, in connection with defendant's sale of bottled water that had been distributed gratuitously as relief supplies in the aftermath of Hurricane Charley, is reversed where the state failed to prove that the distributor of the supplies relied on a misstatement of fact made by defendant concerning his intended use of the bottled water.
