An order of the Construction Industry Licensing Board of the Department of Business and Professional Regulation denying an application for licensure in the state is reversed where, by earlier accepting appellant's voluntary relinquishment of his license and agreement not to reapply for a license in Florida for at least five years, the Board essentially forfeited the opportunity to later penalize him for the earlier conduct.
