Bowen v. Brewer, 2D05-3400
In a dispute between owners of adjacent properties over alleged deposits of sewage sludge on defendants' property, a judgment for attorney's fees and costs in favor of defendants following summary judgment is reversed in part where a finding, that plaintiffs should have known before or shortly after suit was filed that the allegations against defendants were unfounded, was not supported by competent, substantial evidence.
