Mitchell v. DiMare, 5D05-1691

A trial court ruling finding that plaintiff, a licensed real estate broker, was not entitled to a commission in connection with a real property purchase contract he procured is affirmed where plaintiff was not entitled to a commission under a brokerage agreement since no binding contract existed between parties because a contract plainly provided that the contract would not become effective unless a right of first refusal was rejected.
