An order of the Public Employees Relations Commission (PERC) summarily dismissing an unfair labor practice charge filed by a union against the State of Florida is affirmed where provisions of the Florida Administrative Code, which had been incorporated into the parties' collective bargaining agreement, had been superseded by subsequent legislation and an implementing rule establishing a new procedure for imposing layoffs.
