Harris v. State of Florida, 5D05-2672

In order to commit the crime of resisting an officer without violence, a defendant must have know that the individuals he resisted were officers. Defendant's conviction for resisting an officer without violence is reversed in part where a failure to instruct the jury on the knowledge element required reversal of the conviction and a remand for new trial.
